I rent a studio attached to the house of a family, whose head I pay rent to (presumably my landlord). I did sign a lease upon moving in. I have no way of knowing if the man I've been paying rent to is the real owner of the house, or if he is just renting the house himself. The family is now supposedly buying another house in a neighboring town, but he will continue to rent me the studio while he rents the rest of the house out through a management company. His family has already moved out. I'm worried that he was never the true owner of the house, and that he has moved out, leaving me in the house appearing to be a squatter. If I get an eviction order/notice from whomever may really own the property, how long do I have to vacate considering that I may not have had a legal agreement with the true owners of the house?I believe i may be the victim of a property rental scam. I need advice on what to do...?
contact the the tax assessors office in which the property is located- and ask for the owners name of the property on record, and address if you have been paying by mail. this is public information and they should tell you over the phone although - you may need to go down there and look it up. if it is not the owner of the property that you have been paying then you need to confront the person you have been paying. they may be a property manager or someone appointed by the owner to rent it out and collect monies, if that is the case then you lease is still good. if not then you should try to track down the real owner and tell them of the situation- in some cases subletting is ok - in other cases it is not, it really depends on the lease agreement that that person had originally, and what the real owner(whoever it is) knows of this or thinks of this. if you signed this lease with no knowledge of wrong doing then you will be safe for a while- a few months at least. if the person who rented it to you did so without permission from the owner then they are the one to be in trouble- but if the owner really is not aware you are there - they can and probley will evict you - but the judge should see you were stuck in a bad situation and will probley give you several months to move (3 to 4 maybe). sadly you will have to waste your time and show up at court a few times. you can always bring a small claims suit for the stress and moving costs against the person who rented the place if your lease is found to be invalid...but who knows if anything will come of it.I believe i may be the victim of a property rental scam. I need advice on what to do...?
I find it hard to believe that the true LL or the manager did not find out that someone was living in that studio. A good LL and mgr. will check on his/her properties and it doesn't take long to figure out that someone is living where they shouldn't be living. Why would you think that the ';true LL'; would just find out now, right after the person renting to you left if the ';true LL'; hasn't found out up to this point? Anyway, if you were given a notice and signed a lease under false presumptions that lease probably would not hold up in court as it was not the real owner. Technically, I believe the LL could call the cops and have you arrested or at least removed as the true LL did not have you sign a lease and didn't put you into the studio in the first place. It would then be taken to court and I'm sure it would be you, the fake LL, and the real LL if they even made the real LL appear. Why didn't you go to city hall to figure out who owned it if you had suspicions from day one? It would have saved you a lot of problems in the future.
